§ 4733. Prohibited provision. (a) General rule.-- It shall be unlawful for any agreement to contain a provision requiring the operation
of a retail motor vehicle fuel station during those hours that are proven by a retail
motor vehicle fuel station owner or operator to be unprofitable to such owner or operator. (b) Definitions.-- As used in this section, the following words and phrases shall have the meanings given
to them in this subsection: "Agreement." A contract or lease, or combination of both, or other terminology used to describe
a contractual relationship between any or all of the following parties: a refiner,
a distributor and a retail motor vehicle fuel station owner or operator. "Distributor." A person who purchases motor vehicle fuel from a refiner for the purpose of resale
to a retail motor vehicle fuel station. "Refiner." A manufacturer of motor vehicle fuel. "Retail motor vehicle fuel station." A place of business where motor vehicle fuel is sold and dispensed into the tanks
of motor vehicles, either by means of a self-service or full-service pump. (Dec. 18, 1992, P.L.1411, No.174, eff. 60 days) 1992 Amendment. Act 174 added section 4733.
