Penalties

Any violation of Sections 4, 6 or 7 of this Act, unless otherwise specified, is a Class A misdemeanor for a first violation and a Class 4 felony for a second or subsequent violation. Any violation of administrative rules adopted under this Act is a Class B misdemeanor. Each disturbance of human remains, unregistered graves, grave markers, or grave artifacts constitutes a separate offense. (Source: P.A. 103-446, eff. 8-4-23.)
