Distinctive plates for Persian Gulf veterans

* § 404-w. Distinctive plates for Persian Gulf veterans. 1. Any\nPersian Gulf veteran or the spouse of any such veteran shall, upon\nrequest, be issued a license plate bearing the words "Persian Gulf\nVeteran". If a distinctive plate is issued to a veteran pursuant to this\nsection, such a distinctive plate shall not be issued to the spouse of\nsuch veteran. Application for said license plate shall be filed with\nthe commissioner in such form and detail as the commissioner shall\nprescribe.\n 2. The distinctive plate authorized in subdivision one of this section\nshall be issued upon proof, satisfactory to the commissioner, that the\napplicant or the spouse of the applicant is a Persian Gulf veteran.\n 3. For the purposes of this section, "Persian Gulf veteran" shall mean\na person who is a resident of this state, who served in the armed forces\nof the United States in the hostilities that occurred in the Persian\nGulf from the second day of August, nineteen hundred ninety to the end\nof such hostilities, and was (a) honorably discharged from the military,\nor (b) has a qualifying condition, as defined in section one of the\nveterans' services law, and has received a discharge other than bad\nconduct or dishonorable from such service, or (c) is a discharged LGBT\nveteran, as defined in section one of the veterans' services law, and\nhas received a discharge other than bad conduct or dishonorable from\nsuch service.\n 4. A distinctive plate issued pursuant to this section shall be issued\nin the same manner as other number plates upon payment of the regular\nregistration fee prescribed by section four hundred one of this article\nprovided, however, that an additional one time service charge of ten\ndollars shall be charged for such plate.\n 5. Nothing contained herein shall require the issuance of a special\nnumber plate under this section unless the commissioner is satisfied\nthat the aggregate amount of annual service charges collected pursuant\nto subdivision four of this section will be sufficient to recover the\ncosts of the design and manufacture of such special plates.\n * NB There are 2 § 404-w's\n
