(a) Each of the following types of wells shall be equipped with a water flowmeter meeting the water flowmeter and installation specifications in K.A.R. 5-1-4 through K.A.R. 5-1-12 at the time the well is permitted: (1) Any nondomestic, nontemporary well permitted or drilled after May 1,1980; (2) any nondomestic, nontemporary well actually drilled after May 1, 1980 pursuant to an approval of an application for a change in point of diversion; and (3) any well reduced in annual quantity of water authorized in order to allow approval of another application pursuant to K.A.R. 5-24-2 . (b) In addition to meeting the requirements of this regulation, each owner shall meet the requirements specified in K.A.R. 5-3-5e . (Authorized by K.S.A. 82a-1028 , as amended by L. 2002, Ch. 137, § 5, and K.S.A. 82a-706a ; implementing K.S.A. 82a-1028 , as amended by L. 2002, Ch. 137, § 5, and K.S.A. 2001 Supp. 82a-1903 , as amended by L. 2002, Ch. 137, § 7; effective Jan. 10, 2003.)
