Authority: IC 5-10.5-4-2 Affected: IC 5-10.4-5-17 Sec. 12. A member who: (1) receives a service credit determination from INPRS that incorrectly states the member's vested status; and (2) subsequently relies on that determination during the member's decision to resign his or her position; may be eligible for vested status, if that member's retirement application is denied. Such cases shall be evaluated on a case by case basis and whether vested status is granted depends on the unique facts for each member's situation. Any service credit granted shall be used for pension eligibility purposes only and shall not be used in the calculation of a benefit.
