Scope of practice.

RELATES TO: KRS 314A.100 STATUTORY AUTHORITY: KRS 314A.205(3) NECESSITY, FUNCTION, AND CONFORMITY: This administrative regulation clarifies the types of activities which are permissible by persons holding certification as a respiratory care practitioner. Section 1. Definitions. "Agency or facility guidelines" shall mean a written set of guidelines for initiating, adjusting or discontinuing care which have been approved by the medical director. The "agency or facility guidelines" shall also describe the specific training or education necessary to enable the respiratory care practitioner to competently perform each of these procedures. Section 2. A respiratory care practitioner shall perform respiratory care procedures not specified by KRS 314A.100 in accordance with agency or facility guidelines. Section 3. (1) A respiratory care practitioner shall be responsible for practicing within his level of competence. (2) The following conduct by a respiratory care practitioner shall constitute unethical conduct in the practice of respiratory care: (a) Failure to practice within their level of competence; (b) Engaging in those procedures specifically prohibited by KRS 314A.100; or (c) Performing procedures not listed in the agency or facility guidelines.
