12:68:20:05. Procedures and methods of impoundment. If the board or an agent contracted by the board determines that impoundment of an animal is necessary under authority of SDCL chapter 40-1, the board or contracted agent shall, if circumstances allow, obtain from the court having jurisdiction an order for the impoundment. If circumstances appear to the board or its contracted agent to dictate, impoundment may take place in a reasonable and expeditious manner without a court order. Any impoundment under the authority of this chapter must be for the immediate and continued alleviation of inhumane treatment or threat to the physical well-being of other owned animals or humans.
