Agr 205.02 Petition for Rulemaking. (a) Any person may request the department to commence a proceeding for the purpose of adopting, amending or repealing a rule. (b) This request shall be made by filing a petition with the department which contains: (1) The name and address of the individual filing the petition or if the petition is being filed by an organization or other entity, the identity of the organization or entity and the name and address of the representative authorized by the organization or entity to file the petition; (2) Reference to the statutory provision that authorizes or supports the rulemaking petition; (3) A statement of the purpose of the petition, whether adoption, amendment or repeal of a rule and the results intended by the petitioner to flow from the implementation of the proposed adoption, amendment or repeal of a rule; (4) If amendment or adoption of a rule is sought, a copy of the text proposed; (5) An identification of the particular rule sought to be amended or repealed, if the petitioner proposes to amend or repeal an existing rule; and (6) Any data or argument the petitioner believes would be useful to the department in deciding whether to commence a rulemaking proceeding.
