R4-22-506. Perioperative Period; Patient Discharge An osteopathic physician performing office-based surgery shall ensure all of the following: 1. The physician is physically present in the room where office-based surgery is performed while the office-based surgery is performed; 2. After the office-based surgery is performed and until the patient’s post-sedation monitoring is discontinued, a physician is at the physician’s office and sufficiently free of other duties to respond to an emergency; 3. If using minimal sedation, the physician or a health care professional certified in ACLS, PALS, or BLS is at the physician’s office and sufficiently free of other duties to respond to an emergency until the patient is discharged; 4. If using moderate or deep sedation, the physician or a health care professional certified in ACLS or PALS is at the physician’s office and sufficiently free of other duties dis- to respond to an emergency until the patient is charged; 5. A discharge is documented in the patient’s medical record including: a. The date and time of the patient’s discharge, and b. A description of the patient’s medical condition at the time of discharge; and 6. The patient receives discharge instructions and receipt of the discharge instructions is documented in the patient’s medical record.
