A. A person who violates any provision of this Chapter or the Act shall be subject to a civil penalty of not more than $500 for each violation. B. Each day on which a violation occurs shall constitute a separate offense. C. Penalties may be assessed only by a ruling of the commissioner based upon a recommendation by the Weights and Measures Commission adjudicatory hearing held pursuant to R.S. 3:4605 and the Administrative Procedures Act. D. In addition to civil penalties, the commissioner may institute civil proceedings seeking injunctive relief to restrain and prevent violation of the provisions of this Chapter and the Act in any court of proper jurisdiction and venue.
