For purposes of the minimum distance from the Facility Site of a certified business firm to Interstate Highway 5 (I-5) under ORS 285C.412(3)(b) or (5)(b): (1) Measure the distance as: (a) A straight line; and (b) The shortest possible gap between any part of the Facility Site and a point along the median of the highway, regardless if that point is in this state or offers access on/off the highway. (2) Exclude any spur or bypass such as I-105 or I-205. (3) Round distances to the nearest whole number, such that an applicable location must be effectively farther than 10.4 miles from I-5.
