KAWAIHAE HARBOR, HAWAII

§13-55-1 Definitions. As used in this chapter unless otherwise provided: "Kawaihae Harbor" means that harbor situated at Kawaihae, South Kohala, island of Hawaii, Hawaii. [Eff: DEC 4 1989 ] (Auth: HRS §188-53) (Imp: HRS §188-53)

§13-55-2 Prohibited activities. (a) No person shall engage in the following activities within that portion of Kawaihae Harbor bounded by a line as delineated in the "Map of Kawaihae Harbor, Hawaii 5/22/89", located at the end of this chapter: (1) Fish with more than two lines, or two poles or rods and lines; (2) Snag or attempt to snag any fish; and (3) Use any type of nets, except hand nets not exceeding three feet (0.92 meter) in any dimension to take shrimp or nehu for bait purposes only, or to land fish already hooked. (b) Nothing in this chapter shall be construed as allowing activities within any portion of the Kawaihae Harbor which may be otherwise prohibited by law or rules adopted by the department of transportation [Eff: DEC 04 1989 ] (Auth: HRS §188-53) (Imp: HRS §188-53)

§13-55-3 Permitted activities. The department may issue permits to engage in activities otherwise

prohibited by law or section 13-55-2 for scientific, propagation, or other purposes as provided by law, provided, however: (1) The board may revoke any permit for any infraction of the terms and conditions of the permit; and (2) A person whose permit is revoked shall not be eligible to apply for another permit until the expiration of a specified period from the date of revocation as provided by law. §13-55-4 Penalty. Any person violating the provisions of this chapter, or the terms and conditions of any permit issued as provided by this chapter, shall be punished as provided by section 188-70, Hawaii Revised Statutes. [Eff: DEC 4 1989 ] (Auth: HRS §188-53) (Imp: HRS §188-70)
