R3-8-407. Joint Responsibility A. An applicator, qualifying party, branch supervisor, or busines s licensee who supervises another person shall ensure that th e supervised person is properly trained and equipped an d receives the supervision necessary for the supervised person t o pes- provide pest management services in accordance with the ticide label and labeling, this Chapter and the PMD statutes. It is an affirmative defense to joint responsibility as describe d in subsection (B) if an applicator, qualifying party, branc h supervisor, or business licensee complied with subsection (A) and can demonstrate that compliance with contemporaneousl y maintained records. D. A QP and business licensee shall comply with every provisio n in this Chapter regarding applicator duties and responsibilities.
