An individual who irrigates with effluent pumped from a confined feeding facility lagoon or runoff retention pit shall not be required to have an approval of application pursuant to K.S.A. 82a-701 et seq. and amendments thereto, unless there are more than 15 acre-feet of average annual runoff meeting the following criteria: (1) Is generated from outside of the confined feeding facility; (2) is impounded in the lagoon or runoff retention pit; and (3) is used for irrigation purposes.
