Golden buckeye program: cardholder records.

(A) ODA may retain cardholder records. (B) A cardholder record is not a public record subject to inspection or copying under section 149.43 of the Revised Code. (C) ODA may use the contact information in cardholder records to inform cardholders about the programs of ODA, other governmental agencies, or certain entities who are approved by ODA, unless restricted from doing so by Chapter 173-13 of the Administrative Code or any statute or rule identified in rule 173-13-04 of the Administrative Code, including sections 173.061 and 4501.27 of the Revised Code, 18 U.S.C. 2721(c), and rule 4501:1-12-02 of the Administrative Code. (D) ODA's director (or the director's designee) may disclose contact information from cardholder records to other governmental agencies and organizations to inform cardholders of programs or information sponsored or supported by those governmental agencies or organizations, unless restricted from doing so by Chapter 173-13 of the Administrative Code or any statute or rule identified in rule 173-13-04 of the Administrative Code, including sections 173.061 and 4501.27 of the Revised Code, 18 U.S.C. 2721(c), and rule 4501:1-12-02 of the Administrative Code. Any governmental agency or organization receiving cardholder records shall use cardholder records only to inform cardholders of the programs or services of the governmental agency or non-profit organization. (E) ODA shall not disclose information in cardholder records containing a cardholder's medical history.
