Emergency rules shall be filed with the Index Department as provided in this Subpart, Sections 100.220, 100.500, 100.510, and 100.540 of this Part and Section 5-45 of the IAPA. When an agency files an emergency rule, a situation must exist which the agency finds reasonably constitutes a threat to the public interest, safety or welfare . Accompanying the emergency rules must be: a) a certification of the emergency rules as shown in 100.Appendix C, Illustration C. This certification must specify the reason for the emergency, and b) a cover letter specifying the material being submitted and the reason for submission (filing, Register publication, review, etc.).
