Eligibility requirements.

Each account owner shall meet the following requirements: (a) Be a resident of the state of Kansas; (b) reside in a household with a combined federal adjusted gross income for all individuals residing in the household that is not more than 200 percent of the current federal poverty level; and (c) not be claimed as a dependent on someone else's income tax return. This regulation shall be effective on and after January 1, 2010.
