Discharge, recovery, and reporting requirements.

(a) Each owner or operator shall recover promptly any discharge. The owner or operator may use the recovered pesticide for its intended purpose if it can be used according to the recovered pesticide's label or labeling. The owner or operator shall dispose of, in accordance with the label, any recovered pesticide that cannot be used. (b) The owner or operator shall notify the secretary within 48 hours of any discharge not contained by secondary containment.
