Authority: IC 5-10.5-4-2; IC 36-8-8-5 Affected: IC 36-8-8-12.3 Sec. 6. In order for the INPRS board to make a determination with respect to a fund member's disability, the 1977 Fund must receive a certification from the local safety board that there is no suitable and available work in the member's department for which the fund member is or may be capable of becoming qualified, considering reasonable accommodation to the extent required by the Americans with Disabilities Act. The 1977 Fund will not process an application for disability unless the appropriate certification is included with the application for disability benefits.
