(1) An application for registration as an immigration consultant shall be executed on a form approved by the division, and include: (a) the applicant's: (i) name; (ii) street address; (iii) mailing address; (iv) telephone number, and if applicable, facsimile number; (v) email address; (vi) web address, if the applicant maintains a website; (vii) driver license or identification card number; (b) a complete fingerprint card and the applicant's consent to a fingerprint criminal background check by the Utah Bureau of Criminal Identification; (c) a certification, under penalty of perjury, that the applicant is: (i) a United States citizen; (ii) a qualified alien as defined in 8 U.S.C. Sec. 1641; or (iii) lawfully present in the United States; (d) a complete list of: (i) any other name used by the applicant at any time past or present; and (ii) any entity name, including any dba, the applicant uses while acting as an immigration consultant; (e) a copy of any contract that the applicant will use to create a contractual obligation with a client; (f) a copy of the disclosure document the applicant is required to provide to a client in accordance with Subsection 13-49-303(2): (i) written in English; and (ii) written in each native language of the applicant's clientele; and (g) a cash bond or surety bond payable to the division in accordance with Section 13-49-204.
