An order permitting issuance of a Rule 17(c) subpoena may be obtained by filing either a motion pursuant to F.R.Crim.P. 47 or, for good cause, an ex parte application (and proposed order) may be filed under seal without advance notice to the opposing party. If the Court grants the ex parte application to issue and seal the subpoena, 12/1/2025 Chapter III - 5 LOCAL RULES – CENTRAL DISTRICT OF CALIFORNIA the Marshal must not disclose the issuance or service of the subpoena to anyone except as authorized by the Court.
