For the judge to consider a stipulation, the party against whom the stipulation is asserted: 23 M I D D L E D I S T R I C T O F F L O R I D A L O C A L R U L E S (a) must concede the existence of the stipulation, (b) must have confirmed the stipulation in writing, or (c) must have stipulated on the record, including during a deposition.
