For purposes of 18 U.S.C. § 3161(h)(1)(H), a proceeding concerning Defendant is actually under advisement by the court on the latest of: (a) The date that the last brief is timely filed; 16 (b) If an optional brief is not filed, the date the last optional brief would have been due pursuant to these local rules or order of the court; (c) If the last brief is untimely filed, the later of: (1) the date the last brief is untimely filed; or (2) if the court announces a determination as to whether to consider the untimely filing or not, the date of that announcement; or (d) If the court holds hearing(s), the date of the last hearing on the matter.
