Every ex parte application for the appointment of counsel to represent the target of a federal investigation relating to potential charges that might be considered punishable by death (“Pre-Indictment Death- Eligible Matter”) is assigned to a district judge immediately, without waiting for an indictment to be filed. When the indictment or other charging document is eventually filed, therefore, the government must, if aware of a previously filed Pre-Indictment Death-Eligible Matter related to any of the crimes charged, concurrently file a Notice of Case Related to Pre-Indictment Death-Eligible Matter identifying the previously assigned matter.
