Upon the filing of a notice of appeal and a statement of election to have the appeal heard by the District court, the Clerk of the Bankruptcy Court shall forward to the Clerk of the District Court the notice of appeal, the statement of election and the docket sheet. Bankruptcy Rules 8003(d)(1) and 8005(b). If a statement of election is filed by an appellee, the notice of appeal BKR 39 (Effective May 4, 2026) and the statement of election will be received from the Bankruptcy Appellate Panel. In either case, the Clerk of the District Court shall immediately open a file, docket these documents and give notice to the parties of the name of the assigned District Judge and the District Court case number.
