(a) A motion filed under Federal Rules of Civil Procedure 26 through 37 concerning a discovery dispute must state that: (1) After consultation in person, by telephone or by email, and after good faith attempts to resolve the dispute the parties are unable to reach an agreement; or 23 (2) Movant’s attempts to engage in such a consultation were unsuccessful. If a consultation has occurred, the motion must state the consultation’s date, time and place as well as the names of the participants. If movant attempted unsuccessfully to have a consultation, the motion must describe in detail movant’s efforts. (b) A motion to compel discovery responses must attach a copy of the discovery request and any response.
If the motion fails to attach the request and response, the court may deny the motion without a hearing.
