If a party to an adversary proceeding based on a complaint objecting to a debtor’s discharge seeks to voluntarily dismiss the proceeding, the party must file a motion and affidavits from both the plaintiff(s) and the debtor(s) affirming the debtor has not given or been promised any consideration in exchange for the Revised 12/1/24 Page 71 of 88 dismissal of the adversary proceeding or, if some consideration has been promised or given, then movant must describe the nature, terms, and amount of that consideration. All motions for voluntary dismissal of a § 727 complaint must be set for hearing, with notice to all creditors using the conventional noticing procedure.
