PROTECTION PAYMENTS

Pre-confirmation adequate protection payments governed by 11 U.S.C. §1326(a)(1)(C): (a) may only be made by the chapter 13 trustee; and (b) shall be proposed by the debtor using Local Form 3015-4(b), which shall be filed and served with the debtor’s chapter 13 plan, or (c) if the debtor does not tender Local Form 3015-4(b) with their chapter 13 plan, a secured creditor can propose adequate protection payments using Local Form 3015- 4(c). Within 7 days of entry of the signed order, the secured creditor must serve a copy of the signed order upon all parties in interest and must file a certificate of service that the secured creditor has complied with this requirement.
