U.S. Bankruptcy Court for the District of Nevada
ORDER DECLARING LIEN SATISFIED IN CHAPTER 12 AND Following successful plan completion in a chapter 12 or chapter 13 case, a debtor may file a motion requesting an order under Fed. R. Bankr. P. 5009(d) declaring the lien satisified and that the lien has been released under the terms of the completed plan. If the motion solely seeks remedies under Rule 5009(d), then the motion may be brought on negative notice as described in LR 9014.1. Unless good cause is shown, the court will not entertain motions to compel the release of such liens or to impose sanctions against creditors who do not release such liens, unless the debtor first complies with Fed. R. Bankr. P. 5009(d).
