case when the plan has been accepted by the requisite majorities and no objection to confirmation has been filed, the plan proponent may establish that the plan meets the applicable requirements of Code § 1129(a) by oral offer of proof, provided that any witness whose testimony is being proffered is present. A plan proponent making an oral offer of proof must file a written offer of proof in the form of an unsworn declaration authorized by 28 U.S.C. § 1746 in support of confirmation prior to the confirmation hearing.
