The defendant shall not be present during settlement discussions, unless otherwise ordered by the settlement judge. However, the defendant shall be available (a) in the courtroom of the settlement judge, if the defendant is not in custody or (b) in the Marshal’s lock-up, if the defendant is under pretrial detention, unless the defendant's availability is waived by the settlement judge.
