Authority. Under 28 U.S.C. § 651, the District of Utah offers a judicial settlement conference as an alternative to an adjudication by the assigned judge in all civil cases and bankruptcy adversary proceedings. Under 28 U.S.C. § 636(b)(1) and Fed. R. Civ. P. 16, the judge to whom the case has been assigned for trial may refer the case for a judicial settlement conference to be conducted by another judge. Stay. A party may move under DUCivR 7-1(a)(4)(D) to stay the case or discovery after an order has been entered authorizing a judicial settlement conference. A stipulation to stay the action or discovery is ineffective without a court order.
