Comment
The purpose of the initial disclosures pursuant to LPR 2.2 – 2.5 is to identify
the likely issues in the case, to enable the parties to focus and narrow their
discovery requests. Permitting use of the initial disclosures as evidence on
the merits would 4 defeat this purpose. A party may make reference to the
initial disclosures for any other appropriate purpose.
