Your appearance on Zoom should only be your first and last name. No aliases, firm names, client names, use of other persons’ accounts will be accepted.

Upon joining the meeting, you will be placed in a waiting room.  Please wait patiently while court staff assists in moving you from the waiting room to the main room where the hearing will take place.

You may be asked to join a breakout room upon joining the main room.  The main reasons parties are asked to join a breakout room are failure to appear under your full first and last name, the need to identify a party’s role in a matter or because staff have noted you have not connected your audio correctly. 

Once admitted into the hearing, please ensure your audio is muted.  Those dialing in by phone may mute/unmute their phone by pressing *6. Your audio is to be muted until either:
- Your matter is called,
- You would like to speak up on a matter handled in chambers, or
- You are addressed directly by the court.

Your camera must be off until your matter is called.  When your matter is called, turn on your camera and leave it on until the matter is concluded.

Mute your connection again only after the case in which you are appearing is concluded in its entirety or you are given leave to by the court.

Avoid using a speakerphone or calling from a public place.  Headsets are encouraged.  Background noise is prohibited.  Parties causing unwarranted noise on the line may be muted by the court or dismissed from the hearing.

If an original motion is to be noticed for a day on which other matters in the same case are to be heard, the original motion should be noticed for the time already set – not the original motion time.

If no response has been filed, parties may withdraw a motion and not appear if they file an electronic notice of withdrawal to inform all appropriate parties that the motion is being withdrawn.

All contested matters (defined in Bankruptcy Rule 9014), motions or requests must be served in compliance with Bankruptcy Rule 7004. Corporations must be served as required under Rule 7004(b)(3) on an officer, managing or general agent, or on any agent authorized by appointment or by law to receive service of process. Service of a corporation at a P.O. Box to which payments are sent is not sufficient.

A party who objects to a motion and wants it called must file a notice of objection no later than two business days before the date of presentment.  See L.R. 9013-1(F). If no objection is timely filed, the court may grant the motion in advance.

Motions that are granted in advance will be listed as having been “Granted Without a Hearing” on the call sheet for the hearing date.  If a motion is “Granted Without a Hearing,” it will be marked as such in the Court Calendar by no later than 4:00 p.m. the day before the motion is to be presented.

If a party to a matter that has been “Granted Without a Hearing” seeks to have the matter called, the party must contact the Courtroom Deputy to request that the motion be called, and the Courtroom Deputy will call the motion.

If a motion scheduled on the call as “Granted Without a Hearing” is called, the court will either grant the motion over the objection or continue it to give the movant an opportunity to be heard.

When a motion has been heard by the court and the party seeking relief is directed to submit a draft order after the hearing, the order must be filed in fillable format on the docket via CM/ECF using the “Proposed Order” event within 14 calendar days of the hearing or as otherwise ordered.  Once the order has been filed, notice must be given to the courtroom deputy by phone or email at [email protected] that the order was filed.

Motions to continue the automatic stay in effect under 11 U.S.C. § 362(c)(3) or to impose the automatic stay under § 362(c)(4) must:

1. State the case number of previous cases dismissed within one year of the filing of the present case;

2. Include copies of Schedules I and J from all previous cases dismissed within one year of the filing of the present case, and Schedules I and J from the current case;

3. State in detail the bases for continuing the stay in effect or imposing the stay; and

4. Attach a detailed affidavit containing specific facts

demonstrating all circumstances, including those relating to the

substantial change in the debtor financial or personal affairs, to rebut the presumption that the case was filed in bad faith.

Motions to modify a confirmed plan under 11 U.S.C. section 1329 must include amended schedules I and J if changes in income or expenses are the reason for the relief sought.

When filing a motion for a Rule 2004 examination, the movant must either (1) attach the proposed discovery requests (deposition requests, document requests, or other discovery procedure) to their motion or (2) summarize the discovery that they will be seeking within the text of their Rule 2004 motion.

Motions that do not comply with this procedure may be denied summarily without prejudice.

Cases filed under Chapters 7 and 11:
All attorneys or other professionals in cases filed under Chapters 7 and 11 seeking approval of their fees must submit an itemization of their time in tenths of an hour and in the format required under Local Rule 5082-1.

Cases filed under Chapter 13:
All attorneys seeking approval of their fees in Chapter 13 cases must file an application with an itemization of their time in tenths of an hour, unless a flat fee is authorized pursuant to Local Rule 5082-2. A fully executed Court-Approved Retention Agreement (CARA) revised as of 9/19/16 must be attached if applicable.

If parties in matters before Judge Peterman agree that mediation would be worthwhile, the parties should ask the court (either during a status conference or by joint email to the Courtroom Deputy) for referral to a mediator, at which point Judge Peterman will attempt to find a judge for referral. Judge Peterman will not mediate in cases that are assigned to her.  The following procedures will apply:

1. The assignment of a matter to mediation does not relieve the parties to that matter from complying with any other Court orders or applicable provisions of the Bankruptcy Code, the Federal Rules of Bankruptcy or the Local Rules. Unless otherwise ordered by the Court, the assignment to mediation does not delay or stay discovery, pretrial hearing dates or trial schedules.
2. Participants in mediation are prohibited from divulging, outside of the mediation, any oral or written information disclosed by the parties in the course of the mediation. No person may rely on or introduce as evidence in any proceeding any aspect of the mediation unless such information is otherwise discoverable or admissible. The parties are bound by Fed. R. Evid. 408 and any applicable federal or state law equivalents relating to settlement discussions, mediations, or alternative dispute resolution procedures.
3. If a settlement is reached at a mediation, the plaintiff must file a Notice of Settlement or, where required, a motion and proposed order seeking Court approval of the settlement within 14 days after such settlement is reached.

When another judge has referred a case to Judge Peterman for mediation, the following guidelines will apply:

1. The parties are responsible for contacting chambers to schedule the mediation and must be prepared to communicate to chambers the anticipated length of the mediation and at least three (3) dates on which all parties are available to mediate.
2. Judge Peterman may require the parties to execute an agreement confirming the confidentiality of the mediation proceedings, the applicability of the mediation privilege, and Judge Peterman’s absolute immunity from suit related to such proceedings.
3. Judge Peterman (or someone from her chambers) will send an email to the parties to request a position paper from each party.  In that email, Judge Peterman will set the due date, a length restriction, her requirements for the content and whether the papers are to be provided to the other parties.  The papers are not, under any circumstances, to be filed with the court.
4. The parties are advised that Judge Peterman anticipates scheduling ex parte conferences or conference calls, separately with each side, in advance of the mediation, to ensure that the time spent in mediation is used efficiently.
5. The parties must agree to make a good faith attempt to settle through mediation and are required to have at least one person of decision-making authority in attendance at the mediation with their counsel.
6. The contents of the position papers and the mediation conference itself are to be kept confidential and must not be disclosed to anyone outside of the mediation conference.  This includes the presiding judge to whom the case is assigned.
7. All mediation communications, whether with the court or between parties, are considered settlement communications and are subject to Fed. R. Evid. 408 and any applicable federal or state law equivalents relating to settlement discussions, mediations, or alternative dispute resolution procedures.

Any party that requests and/or agrees to mediation acknowledges and agrees that the United States District Court for the Northern District of Illinois, Local Rule 40.3.1, including the proposed amendment of December 4, 2025 (which is pending approval), apply to any mediation in which Judge Peterman participates and any mediation of a case pending before Judge Peterman that is referred to another judge.
