Self Calendaring Procedures

The Northern District will permit counsel to utilize a self-calendaring procedure for the scheduling of matters requiring 30 minutes or less of court time. This procedure will allow counsel to self-select available dates and times on the appropriate judge's calendar and serve notice without contacting the courtroom deputy for a hearing setting. The court strongly encourages the use of this self-calendaring procedure when appropriate. Courtroom deputies are available by email or telephone to schedule non-self calendared hearings as needed.

The self-calendaring procedure for Chief Judge Jernigan is as follows:

NOTE: Occasionally there may be instances where self-calendared matters are rescheduled possibly due to docket congestion or unforeseen schedule changes. In these instances, the courtroom deputy will contact counsel for the movant, as soon as possible, so that a notice of rescheduled hearing may be issued and served.

See General Order 2023-05 to determine if an in-person hearing is required, or if participants may or must appear via WebEx video conferencing. Remote and hybrid hearings should be noticed for "at https://us-courts.webex.com/meet/jerniga." In-Person hearings should be noticed for Judge Jernigan's courtroom located at 1100 Commerce Street, 14th Floor, Courtroom 1, Dallas, Texas.

Types of proceedings that may be set in accordance with the self-calendar procedure:
- Motions for Relief from Stay (preliminary hearings only)
- Motions to Extend the Automatic Stay
- All matters relating to Chapter 13 main cases (scheduled for pre-hearing before the Standing Chapter 13 Trustee)
- Chapter 7 and Chapter 11 general matters (such as motions to sell property, motions to dismiss case, objections to claims, etc.)
- Non-discovery motions in adversary proceedings (such as motions for default judgment, opposed motions for continuance of trial, etc.)
- Matters in complex Chapter 11 cases.
The self-calendaring procedure will not be available for the following:
- Adversary trial docket call and trial dates.
  The courtroom deputy will select the date and time of the trial docket call before issuing the summons and scheduling order.
- Discovery motions in adversary cases.
  Counsel for the movant shall contact the courtroom deputy by e-mail or telephone to schedule the hearing.
- Chapter 11 hearings on disclosure statement or confirmation of plan.
  Counsel for the movant shall contact the courtroom deputy by e-mail or telephone to schedule a hearing on a disclosure statement. Parties shall submit a proposed order for the hearing date and objection deadline on disclosure statements. Following the approval of the disclosure statement, the court will set the confirmation hearing.
- Any matter requiring an order shortening time or requesting an expedited setting.
  An application for an order shortening time is required before a hearing will be set.
  Emergency motions will only be set after judicial review. Once Judge Jernigan has reviewed the application, the courtroom deputy will contact the movant with the hearing date.
- Motions to reconsider a previous court order.
  Motions to Reconsider will be set only after judicial review, if the court deems a hearing is necessary.

Procedure

In order to utilize the self-calendaring procedure, counsel should select an available date and time as shown on the calendar of available hearing settings. The lists of available dates will be regularly updated on the court's website at www.txnb.uscourts.gov. The date(s) selected must be no earlier than as required by applicable national and local rules, as this self-calendaring procedure does not alter notice requirements.
After selecting an available date and time, counsel shall serve proper notice of the matter in accordance with applicable rules. NOTE: If a motion for relief from stay is set by a party in accordance with the self-calendaring procedure more than thirty (30) days after the date the motion is filed, the court deems that the party has waived the 30-day limitation established by 11.U.S.C. Sec. 362(e)(1) and will enter an order to that effect if requested by debtor.
No later than one day after service, counsel shall file all appropriate papers with the court.
Once a matter is set using the self-calendaring procedure and notice served on interested parties, continuances may only be granted by motion and court order.

Failure to comply with the foregoing procedures will result in the matter not being placed on the court's calendar.

Preliminary hearings on Motions for Relief from Stay (all chapters) will be heard on designated Thursdays at 1:30 p.m. by WebEx video conferencing.

Order Submission

Orders submitted for the court’s consideration should be uploaded in ECF and must be in compliance with the Proposed Order Specifications included in the ECF Manual.

Approved orders requiring immediate attention should be uploaded in ECF and counsel should alert the courtroom deputy by email. It is not necessary to notify the courtroom deputy when submitting routine orders that are not time sensitive.

Disagreements over the form of orders should be submitted to the judge in writing by email with copy to opposing counsel. Proposed versions of the order in pdf and word processing format should be attached to the email.

Orders concerning motions that can be considered without a hearing or notice of opportunity for hearing (such as motions to extend time to file schedules and statements, motions to extend deadline to object to discharge, and motions to dismiss case by debtor in Chapter 13 cases) should be uploaded in ECF when the motion is filed.

Orders concerning motions that include negative notice language should be uploaded after the objection period expires, provided no objections have been filed.

Orders concerning motions that require a hearing should be uploaded after the court has conducted the hearing and issued a ruling.

Please allow 7-10 business days for the entry of routine orders. Inquiries regarding the status of an order should be directed to the courtroom deputy.

Scheduling Settings

Most settings are scheduled with at least 24 days notice. Disclosure statements and Chapter 11 plans are set with not less than 31 days notice. Claims objections and trustee’s final account hearings are set with 33 days notice.

All settings, except emergencies and expedited requests, are set in advance of the filing of a motion or application. A notice of hearing must be filed and served in order for the motion or application to appear on the court’s calendar.

Settings requiring 30 minutes or less of court time may be self-calendared. The court strongly encourages the self-calendaring of motions. Judge Jernigan’s self-calendaring procedures and hearing dates are available online at https://www.txnb.uscourts.gov/content/chief-judge-stacey-g-c-jernigan. Self-calendar docket dates can also be found in ECF by clicking the CHAP Chamber Presets link under Reports on the main menu bar.

Settings that do not comply with self-calendaring guidelines may be obtained by sending an email request for setting to the courtroom deputy at [email protected]. It is helpful if the case name and number is included in the subject field of the email. The request should include the motion title and a court time estimate for the hearing. A notice of hearing must be filed within 48 hours of obtaining a setting.

WebEx Hearing Policy

1. General Information. The Court is currently providing remote access to certain hearings through the Court’s WebEx videoconference facilities. Parties, counsel, and other participants are permitted to attend and participate in hearings by telephone and videoconference without prior permission of the Court subject to compliance with the procedures and requirements set forth herein. See General Order 2023-05 which details when a court appearance is required or optional.

2. Witness Testimony. Witnesses may not provide testimony by telephone alone (i.e. without the WebEx video function activated) except in extremely rare, emergency situations in which the Court determines that cause exists to waive the prohibition or where such form of testimony has been pre-authorized by the Court.

3. Protocol for Joining Hearing; Conduct During Hearing. Attendees should join the WebEx hearing at least 10 minutes prior to the hearing start time. Please be advised that a hearing may already be in progress and the Court’s telephonic and videoconference lines are live. During hearings, attendees are required to keep their lines on mute at all times that they are not addressing the Court or otherwise actively participating in the hearing. The Court reserves the right to disconnect or place on permanent mute any attendee that causes any disruption to the proceedings before the Court. For general information and tips with respect to WebEx participation and attendance, please see Clerk's Notice 23-05.

4. Exhibits. Any party intending to introduce documentary evidence at the hearing must file an exhibit list in the case with a true and correct copy of each designated exhibit filed as a separate, individual attachment thereto so that the Court and all participants have ready access to all designated exhibits. If the number of pages of such exhibits exceeds 100, then such party must also deliver two (2) sets of such exhibits in exhibit binders to the Court by no later than twenty-four (24) hours in advance of the hearing unless the hearing will also be conducted in a live format and counsel will be presenting the binders to the Court at the commencement of the hearing. For any witness that is to be called to testify remotely, the party calling the witness is responsible for supplying the witness with all designated exhibits for the hearing.

5. Disclaimer. The Court cannot and does not guarantee that telephonic service and computer connectivity will not be interrupted during the course of a hearing. If the hearing is being conducted in live format, those who elect to participate in a hearing by remote means do so at their own risk understanding that except in extremely rare circumstances the Court will not entertain a request for continuance of the hearing based upon technological failure or any disadvantage experienced on account of an election to attend remotely instead of in person.

Emergency/Expedited Requests

Please notify the courtroom deputy by email to [email protected] when filing an emergency motion or motion for expedited hearing.

Out of respect for the court's time and other parties who need court time, and out of consideration for due process, parties should be thoughtful about whether their matters are genuine emergencies. Requests should specifically state why the relief sought is urgent and cannot wait the required notice period. Certificates of conference are important to the court in evaluating what parties-in-interest have been contacted and do not oppose the request.

U. S. Trustee Docket

The U. S. Trustee’s docket is typically scheduled on the first Wednesday of the month at 1:30 p.m. Settings are scheduled by counsel for the U. S. Trustee.

Chapter 13 Trustee Docket

The Chapter 13 Trustee’s docket is generally scheduled for the second Thursday of each month. The Chapter 13 Trustee’s office prepares the docket, conducts pre-hearing conferences, and provides the court with a list of unresolved matters that require a court hearing. The courtroom deputy only sets matters on this docket when instructed by the judge.

Resets/Removals from the Docket (Non-Lift Stay Motions)

After hearings have been noticed or set by court order, continuances may only be granted by court order upon motion. A party shall either file a written motion or, with the opposing side present or in agreement, present an oral motion. The motion shall establish cause for the continuance. The movant shall confer with the opposing party and advise the court if the motion is contested. A written motion shall not exceed two pages in length. The court may decide the motion by minute entry or by separate written order. The court appreciates a courtesy call or email to the courtroom deputy regarding the desired continuance, but continuances themselves must be by court order.

For settlements and agreed orders obviating the need for a hearing, counsel need not appear at the scheduled hearing if, prior to the hearing, counsel has notified the courtroom deputy by email that parties have settled, that counsel will upload an agreed order or that counsel has otherwise appeared to place the agreement on the record. Otherwise, the parties shall appear at the scheduled hearing to place the agreement on the record.

Fee Applications

Fee applications in Chapter 7 and 11 cases may be filed with negative notice language and set for hearing only if an objection is filed or at the court's direction. If no objections are filed during the objection period, counsel should file a certificate of no objections and upload an order in ECF. Fee applications in Chapter 7 cases may be submitted with the trustee’s final report, but the applicant must inform the court on the style of the pleading and submit an order after the 30-day objection period expires.

General Order 2023-04 shall govern hearings on fee applications in Chapter 13 cases.

Trustee’s Final Report

Notice is mailed by the bankruptcy clerk’s office. No hearing is required for the trustee’s final report unless an objection is filed or the court orders a hearing. If an objection is filed, it will be set for hearing.

Trial Docket Call/Adversaries

Typically, Judge Jernigan’s trial docket call is scheduled on the second Monday of the month at 1:30 p.m. A list of trial docket call dates is available on the court’s website. The judge will schedule trials at the docket call and by signed court order.

The courtroom deputy schedules the trial docket call and trial week and issues the Standing Scheduling Order and summons when a complaint is filed. The plaintiff’s attorney shall serve all parties the Standing Scheduling Order with the summons and complaint. Compromise, settlement, and stipulations are expected to have been discussed in good faith prior to the docket call. Documents are also to be exchanged and marked before the docket call. Pursuant to the Standing Scheduling Order regarding adversary proceedings:

(i) A Proposed Pretrial Order shall be served and filed seven calendar days prior to docket call;

(ii) Proposed Findings of Fact and Conclusions of Law shall be filed seven days prior to docket call; and

(iii) A list of witnesses and exhibits, except for those being used for impeachment purposes, shall be filed with the court.

Trial docket call and trial settings are only reset by motion to continue or oral motion in court. These settings may be taken off the docket for settlements if a letter or email from the attorney of record is received prior to the hearing.

Motions for Default Judgment

After a Clerk’s entry of default has been issued, defendant may move for default judgment at trial docket call or by written motion. If by written motion, a hearing is required. Please obtain a setting from Judge Jernigan’s self-calendaring procedures at https://www.txnb.uscourts.gov/content/chief-judge-stacey-g-c-jernigan.

Motions for Summary Judgment

Motions for summary judgment require a hearing unless the parties request it be decided on pleadings. Settings may be obtained by contacting the courtroom deputy at [email protected]

Chapter 11 Plan and Disclosure Statement

When filing a Chapter 11 plan and disclosure statement, counsel should contact the courtroom deputy for a setting on the disclosure statement. The court requires an order setting hearing in both small business and non-small business cases.

In small business cases, counsel shall (1) file a motion for conditional approval of the disclosure statement, and (2) upload an order granting conditional approval and setting a final disclosure statement hearing/plan confirmation hearing. Conditional approval must be given by the U. S. Trustee and the order conditionally approving disclosure statement must include the U.S. Trustee’s counsel’s signature.

In non-small business cases, counsel shall upload an order setting hearing on disclosure statement when filing the plan and disclosure statement. The order should include the date by which the plan and disclosure statement will be served, the disclosure statement hearing date, and the deadline for ballots and objections.

Motion to Lift/Annul/Modify or Relief from Stay

Typically, Judge Jernigan schedules preliminary hearings on motions to lift stay on Thursday afternoons at 1:30 p.m. Judge Jernigan’s self-calendaring procedures and a list of preliminary hearing dates are available online at https://www.txnb.uscourts.gov/content/chief-judge-stacey-g-c-jernigan . Preliminary hearing dates can also be found in ECF by clicking the CHAP Chamber Presets link under Reports on the main menu bar.

To announce an agreement, default, or pass to another preliminary hearing, counsel for movant should docket a notice of announcement regarding lift stay motion in ECF. The deadline for announcements in Judge Jernigan’s court is 11:59 p.m. on the day prior to the hearing. Announcements received by the deadline will be annotated on the court’s calendar and counsel will be excused from appearing in court. Otherwise, counsel should plan to appear in court and make an announcement on the record.

Motion to Continue/Extend the Automatic Stay

Motions to continue or impose the automatic stay will ordinarily be set on a preliminary lift stay docket unless a special setting is needed to provide adequate notice, or in the rare circumstance that an expedited hearing is granted. Counsel should file a motion to shorten notice and upload a proposed order if allowing less than 21 days’ notice of the hearing.

Motions to Reinstate Case

Motions to reinstate in Chapter 13 cases should be set on the Chapter 13 Trustee’s pre-hearing conference docket. Motions to reinstate in Chapter 7 cases should be set for hearing in the due course of business. If the case was dismissed for deficient documents and the deficiency is promptly cured, counsel should file a motion to reinstate case and contact the courtroom deputy. The court may be willing to reinstate the case without a hearing.

Motions to Extend Time to File Schedules and Statements

Motions to extend time to file schedules and statements in Chapter 7 and 13 cases may be considered without a hearing or notice of opportunity for hearing. Counsel should upload an order in ECF when the motion is filed. The order should include a new deadline that is prior to the 341 meeting date and a hearing date on debtor’s motion to extend or impose stay, if applicable.

In Chapter 11 cases, motions to extend time to file schedules and statements should be set for hearing. The motion should state the UST’s position and the proposed deadline should be at least one week in advance of the 341 meeting of creditors.

Motions to Modify Mortgage Loan

Motions to modify mortgage loan should include negative notice language, have a copy of the loan agreement attached, and otherwise comply with Amended Clerk’s Notice 14-05. The court will not approve motions that are not in full compliance.

Motions to Reopen Case for Financial Management Course Certificate

Motions to reopen case for financial management course certificate may be considered without a hearing or notice of opportunity for hearing. Counsel need not upload an order when the motion is filed. The court will typically decide the motion on the pleadings and enter an appropriate order. If the court finds cause to grant the motion, the order will include a deadline by which the certificate must be filed. If the certificate is not filed by the deadline, the case will be reclosed.

Court Copies

A complete paper copy of the pleadings listed below, including all attachments thereto, should be delivered within 48 hours of electronic filing to Judge Jernigan’s law clerk’s attention at 1100 Commerce Street, Room 1254, Dallas, TX 75242-1496. Voluminous documents should be 3-hole punched and placed in a binder.
