Abstract

Appellate court judges who see only the cold record of a biased sample of cases necessarily lack the perspective of the wise trial court Judge Jack Weinstein, a sophisticated champion of jurors and jury trials. A review of his cases and commentary reveals what an astute observer of jurors can learn from watching jurors at close hand. Judge Weinstein provides a roadmap for judges on creative and effective ways to conduct jury trials and for jury researchers on how to understand jury behavior. He also suggests some controversial approaches worthy of further research.
