Abstract

Based on a paper delivered to the Labor Relations Law Section of the State Bar of Michigan on January 13 1973. Much documentation has been omitted but will be supplied by the author upon request. I was somewhat amused when our chairman, Sheldon Klimist, asked me to speak to you about the "emerging law on sex discrimination." Had my topic assignment been race discrimination, the title of my speech probably would have been "recent developments in the law on race discrimination." The difference, of course, is that the law on race discrimination under Title VII has emerged in substantial form and lawyers are now watching mostly for recent developments; whereas, the law on sex discrimination is still malleable and observers are patiently awaiting its full emergence.
