Abstract

Since 1997, proposals for a federal patients' bill of rights have enjoyed strong, bipartisan political support, from Congress, presidential candidates, and the two major political parties in their party platforms. Despite widespread approval, nothing has been adopted, and, furthermore, nothing has even come close. This Article examines developments in markets, state law, and federal court decisions that attest to the continued need for a federal patients' bill of rights.
