Abstract

Draft evaders confront the United States with a difficult dilemma. Pending legislation in Congress would offer amnesty to draft evaders. This Article discusses the extent of the problem and Congressional action on amnesty, providing a basis for examining the legislation by Senators Taft and Koch offering conditional amnesty to those who evaded the draft. This examination is contrasted with arguments from those opposed to amnesty and those in favor of unconditional amnesty.

National harmony and social reunification underlie the grant of conditional amnesty. In conclusion, the author recommends that the proposed grant of amnesty should not be effective until Americans stop dying and serving prison terms in Vietnam.
