4 (b) Corporations and unincorporated associations (other than partnerships and individual proprietorships) may appear only through an attorney licensed to practice in Wyoming. (c) An active member of the Wyoming State Bar shall attend all hearings of any party represented by counsel. Unless excused by the court (after notice to all other counsel) the attorney shall attend all hearings on behalf of the attorney’s client. (d) All counsel and pro se parties shall appear promptly at court settings. State need not appear at implied con- sent hearing. — The department of revenue and taxation is not required to appear either personally or through an attorney in an implied consent driver’s license suspension hearing. It may submit its case by certified record on the refusal form given to the licensee at the time of his arrest. Drake v. State, 751 P.2d 1319, 1988 Wyo. LEXIS 35 (Wyo. 1988). The presence of an attorney representing the state is not required at implied consent hear- ings to support the license suspension of one arrested and charged with driving while under the influence, who refused to submit to chemi- cal sobriety testing. The certified arrest docu- mentation alone is sufficient to support a li- cense suspension. Hooten v. Department of Revenue & Taxation, 751 P.2d 1323, 1988 Wyo. LEXIS 34 (Wyo. 1988).
