98 (E) Producing the Documents or Electronically Stored Information. — Unless otherwise stipulated or ordered by the court, these procedures apply to producing documents or electronically stored information: (i) A party must produce documents as they are kept in the usual course of business or must organize and label them to correspond to the categories in the request; (ii) If a request does not specify a form for producing electronically stored information, a party must produce it in a form or forms in which it is ordinarily maintained or in a reasonably usable form or forms; and (iii) A party need not produce the same electronically stored informa- tion in more than one form. (c) Nonparties. — As provided in Rule 45, a nonparty may be compelled to produce documents and tangible things or to permit an inspection. History: Added February 2, 2017, effective March 1, 2017. Source. — This rule is similar to Rule 34 of the Federal Rules of Civil Procedure. Attorney misconduct. — Attorney violated Wyo. R. Civ. P. 26, 33, and 34 because he failed to obtain from the plaintiff or his care providers evidence of ongoing medical care and resulting expenses; he also failed to comply with a court order directing him to file the order. Bd. of Pro. Resp. v. Struemke, 2024 WY 112, 558 P.3d 540, 2024 Wyo. LEXIS 114 (Wyo. 2024). Sanctions. — Business owners contended that a district court abused its discretion by requiring the owners to pay attorney fees and expenses to an investor that the investor alleg- edly incurred in obtaining discovery; however, when the trial court ordered the business own- ers to comply with a discovery request in July, but the business owners had still not complied by November, the district court acted within its discretion in imposing sanctions.
