The Court will sit en banc to consider the following types of cases: (a) direct appeals; (a) the parties; (b) the State Prosecuting Attorney; (c) the trial court clerk; and (b) cases of discretionary review; (d) if the case is of discretionary review, the (c) cases in which leave to file was granted under Rule 72; court of appeals clerk. Notes and Comments (d) cases that were docketed under Code of Criminal Procedure articles 11.07 or 11.071; Comment to 1997 change: This is former Rule 223. The rule is amended without substantive change. (e) certified questions; and (f) rehearings under Rule 79.
