Sitting en banc or in panels. The court of appeals may sit in panels. The chief judge of

the court of appeals shall determine whether a case will be submitted with or without oral argument and whether it will be submitted to a panel of the court of appeals. A case first assigned to a panel may be submitted en banc upon the approval of the court.
