sent and Represented at Deposition A defendant shall have the right to be present in person at any deposition subject to such terms and conditions as may be established by the judi- cial authority. Upon the application for the taking of a deposition, the judicial authority shall advise any defendant who is without counsel of the right thereto and assign counsel to represent such defendant unless he or she elects to proceed with- out counsel or is able to obtain counsel.
