cials Any person who has not made bail shall be detained in a correctional facility and shall be released from such institution upon entering into a recognizance, with sufficient surety, or upon posting cash bail as provided in Sections 38-7 and 38-9 for his or her appearance before the court having cognizance of the offense, which are to be taken by any person designated by the Com- missioner of Correction at such institution where such person is detained. The person so desig- nated shall deliver the recognizance or cash bail to the clerk of the appropriate court before the opening of such court on the first court day there- after.
