Intent: To establish a uniform procedure for handling outstanding citations and warrants. Applicability: This rule shall apply to courts of record and courts not of record. Statement of the Rule: All outstanding citations issued for parking, traffic and infraction violations and all outstanding bench warrants for misdemeanors may be dismissed if the following procedure is followed: (1) Outstanding citations and bench warrants which were issued at least one year prior to the requested dismissal date shall be identified by the clerk of the court on an order to show cause notice and sent to the prosecutor's office. (2) The order to show cause notice shall specify the date when the prosecutor is to appear and show cause why an outstanding citation or bench warrant should not be dismissed. (3) The clerk of the court may prepare the order to show cause notice as often as monthly but no less than quarterly.
