(a) Motion for Summary Judgment. After the pleadings and discovery are closed, but within such time as not to delay the trial, any party may move for summary judgment. Summary judgment practice is governed by Fla. R. Civ. P. 1.510. (b) Motions to Dismiss. Motions directed to the sufficiency of the petition must be contained in the answer as an affirmative defense. (c) Motion for More Definite Statement. A respondent may file a motion for a more definite statement which must be considered a motion for a statement of particulars in response to the original petition. The motion must disclose the defects in the petition.
