(A) Definition As used in these rules, a “jurisdictional appeal” is an appeal from a decision of a court of appeals that asserts one or more of the following: 35 The case involves a substantial constitutional question, including an appeal (1) from the decision of a court of appeals under App.R. 26(B) in a noncapital case, pursuant to Article IV, Section 2(B)(2)(a)(ii) of the Ohio Constitution; The case involves a felony pursuant to Article IV, Section 2(B)(2)(b) of the (2) Ohio Constitution; The case involves a question of public or great general interest pursuant to (3) Article IV, Section 2(B)(2)(e) of the Ohio Constitution. (B) Instituting a case A jurisdictional appeal shall be filed as provided for in Rule 7.01 and shall proceed in accordance with Rule 7.08. Effective Date: January 1, 2013 Amended: April 1, 2025
