All justices and judges, while actually sitting as a justice or judge in a formal judicial proceeding, should wear a suitable black judicial robe. Probate judges and municipal judges are encouraged to wear a suitable black judicial robe while actually sitting in a formal judicial proceeding. [Amended 9-28-87, eff. 10-1-87.] Comment It is highly desirable for judges to wear a suitable black judicial robe while actually sitting in a formal judicial proceeding. However, the court chose the word “should” rather than the word “shall.” This Rule replaces former Rule 25.
