An interpreter must be qualified and must give an oath or affirmation to make a true translation. COMMENT ON RULE 604 Rule 604 is taken verbatim from it federal counterpart. This rule implements requirements contained in West Virginia Code § 57-5-7 and § 5-13A-8 as well as West Virginia Rule of Criminal Procedure 28. Rule 605. Judge's Competency as a Witness The presiding judge may not testify as a witness at the trial. A party need not object to preserve the issue.
